How to use this template

When you need it

Use immediately when a specific event raises uncertainty about a contractual notice trigger or timing requirement. Prepare from contemporaneous records and executed terms before relying on a proposed deadline calculation.

What it helps you decide

The assessment exposes competing timing interpretations and service requirements. It supports urgent internal administration while preserving the distinction between evaluating a notice question and actually dispatching a valid notice.

How to complete it

  1. Define Notice question and Contract locator. Record Trigger evidence, including earliest relevant awareness and later developments, while preserving contradictory dates and accounts.
  2. State Timing interpretation and Proposed deadline with calendar, time-zone and counting assumptions. Check Service requirement, required recipient and content against actual terms.
  3. Record Actual service evidence where it exists and identify Unresolved action. Escalate uncertainty promptly; this assessment neither issues a notice nor determines entitlement or a time bar.

Who prepares and reviews it

The contract administrator assembles the chronology with site and planning contributors. A second reviewer checks the calculation; qualified counsel addresses legal interpretation, and the authorized contract representative decides and issues any notice.

A mistake to avoid

Selecting the latest convenient awareness date without preserving earlier evidence can undermine the assessment and conceal a timing question requiring immediate contractual review.

Illustrative example

Illustrative example: excavation encounters an unexpected obstruction, and project records show different dates for first observation and formal escalation. The assessment preserves both records and checks the actual notice wording. The authorized representative obtains urgent advice and makes a separately documented decision on notice issuance.
